Introduction

This Agreement contains the terms and conditions that apply to customers for purchases from Tek Import (hereinafter referred to as “Tek Import”) and the Tek Import entity named on the invoice that will be provided to you (“Customer”) on orders for products sold. Customer agrees to be bound by and accepts this Agreement as applicable to Customer’s purchase of product(s) from Tek Import, and/or the Tek Import Internet Website hereinafter named the “Site.”
As a condition of sale, Customer agrees to be bound by and accepts these terms and conditions. These terms and conditions apply (i) unless Customer has signed a separate formal purchase Agreement with Tek Import, in which case the separate Agreement shall govern; or (ii) unless other Tek Import standard terms apply to the transaction as noted herein or elsewhere. These terms and conditions are subject to change without prior written notice at any time, in Tek Import’s sole discretion. Customer is bound by any such revisions and should therefore periodically visit this page to review the current Terms and Conditions to which you are bound.

1. Goods
1.1 Colour & Grain
The wood used in our flooring and furniture varies in colour and grain as the original wood source can be from many different areas, although we select a premium grade wood for the production of our furniture, variations will occur and may be evident in your furniture to varying degrees. This is part of the unique character of furniture made from solid wood and should be expected. We apply strict quality control to our products in order to eliminate those with small defects (nodes or sapwood (bark)).
However, every piece of furniture when complete, has to meet our standard for colour and consistency throughout the piece. The furniture on our Site and stain samples shown online are subject to these variations and your furniture may vary slightly from these samples.

1.2 Dimensions & Weight
Dimensions, weights, design features and hardware may vary slightly from the pictures shown online. We reserve the right to make construction changes to our furniture from time to time in order to incorporate improvements. No changes will be made to the overall design, appearance or aesthetics without your prior approval.

2. Disclaimer
Tek Import does not warrant that all products comply with specific geographical compliance or regulatory restrictions. It is customer’s responsibility to ensure that use of products purchased complies with local jurisdiction codes and all regional, national and international laws and regulations.

3. Pricing
All of the prices displayed on the Site are Recommended Retail Prices (R.R.P) and are all exclusive of VAT. We will attempt to honour our published prices; however, they are subject to change without prior notice, but once we have accepted an order the goods price is guaranteed.
With the validation of your cart orders and after having registered on the Site, the delivery tariff is posted according to the amount of your ordering (See delivery). Tax Charges 17.5% VAT is added to all prices shown, unless otherwise indicated. The price you pay will include delivery surcharges (when applies) and VAT.

4. Deposits and balances payable
For in-stock furniture, we require 100% full payment at time of order, and a 50% non refundable deposit on custom or made or order furniture. The deposit guarantees and secures the production of your furniture. The balance is due upon completion of the furniture and prior ocean shipping from production site.
Payment for the products will be made by approved credit card, wire transfer, electronic funds transfer or some other prearranged payment method agreed to by Tek Import. Invoices are due and payable by the payment date(s) specified through electronic (including but not limited to e-mail), facsimile (fax) and/or writing confirmation between Tek Import and the customer. Tek Import may invoice parts of an order separately.

5. Delivery
Delivery will normally take 10-15 days. If any problems are encountered i.e. a longer delivery time is required or items are temporarily out of stock, the customer will be notified of the new delivery time.
We offer free delivery on all orders over £350.00 plus VAT to mainland UK addresses. For orders under £350.00 a surcharge of £35.00 per order will apply.

6. Returns and refunds
No goods ordered was on the Site can be returned without preliminary assent of Tek Import. To be refunded, the customer has to respect the return instructions given by Tek Import. Any return will have to be carried out in its original packing. Any item returned in good condition and accepted by Tek Import will be credited or refunded to 90 % of its sales value.
The expenses of returns are the responsibility of the purchaser, except for goods not in conformity with the initial order or defective at the arrival and having been the subject of reserves expresses near the conveyor in the 48 hours. All furniture crates are inspected and are in good condition when it leaves our warehouse. All damage incurred en route is the responsibility of the trucking company. Furniture crates have to be inspected immediately upon arrival, refuse the delivery if there is obvious damage to the packaging or accept it conditionally making sure to note this on the shippers bill of lading, then contact Tek Import immediately if any damage is discovered, to enable us to make a claim with the carrier.
Tek Import shall not be liable for special or consequential damages or for any damages arising out of or caused by: (1) Delay, (2) Acts of God or the public enemy, (3) The authority of the law, (4) Strikes, riots or quarantine, (5) The inherent nature or vice of the goods transported.

7. Privacy
Tek Import does not sell, trade, or rent your personal information to others. We are committed to protecting customer’s privacy. We use the information we collect about customer to process customer’s order - the information collected is what is submitted at the time of ordering and this is collected lawfully and in accordance with the Data Protection Act 1998. The secure server software (SSL) encrypts all information you input before it is sent to us. Furthermore, as required by the UK Data Protection Acts of 1984 and 1998, we follow strict security procedures in the storage and disclosure of information which you have given us, to prevent unauthorised access.

8. Governing law
The mail order contract is subjected to the French law. In the event of dispute relating to the application or the interpretation of this Terms of Use, the parts are appropriate to seek a friendly solution. With defect, the courts within the competence of the Court d’Appel in PARIS - France, will be only qualified.

9. Terms of Use
Access to, and use of the Site is governed by Tek Import’s Terms of Use. By using this Site, you signify your acceptance without modification of these Terms of Use. The Terms of Use are subject to change without prior notice at any time, in Tek Import’s sole discretion so you should frequently review the Terms of Use and applicable policies from time to time to understand the terms and conditions that apply to your use of the Site.
